Missouri AG probes illegal THC sales after child illnesses

Missouri Attorney General Andrew Bailey this week launched an investigation into several companies for selling illegal vape and marijuana products that contain delta-8 and delta-9 THC, citing concerns over consumer protection and public health, particularly among children.

The investigation, which also includes disposable e-cigarette products, was prompted by reports of adverse health incidents around the state and nationwide.

In one case, six elementary school children in St. Louis County became ill after allegedly consuming delta-8 products disguised as popular candy, the Attorney General’s office said in a news release, citing a March story by the St. Louis Dispatch newspaper.

Bailey’s office issued Civil Investigative Demands to four businesses:

  • Tariq Zeiadeh, who does business as Vape Society Supplies
  • Cara Buchanan, who does business as Smoke Smart LLC
  • American Shaman Manufacturing Inc.
  • CBD Kratom Connect LLC

“Missourians have a right to live free from fraud and deception in the marketplace, and they have the right to know exactly what is in the products they consume,” Bailey said in a statement.

According to documents, the CIDs require the companies to provide detailed information about their business operations, including identifying their owners, officers, and employees, as well as all physical locations where they conduct business in Missouri.

The companies must also disclose all methods by which they sell their products, including online sales, telephone orders, and in-store sales, as well as identify all internet platforms used for advertising and selling their products.

Additionally, the office is seeking specific information about the companies’ disposable ENDS and delta-8/delta-9 THC products, including sales data, inventory levels, and customer information. The companies must also provide details about their suppliers and the prices paid for those products.

Furthermore, the CIDs require the companies to provide information about their compliance with federal and state tobacco laws, as well as any applications, submissions, or reports they have filed with government agencies in an attempt to comply with these regulations. The office is also interested in any communications between the companies and their wholesalers or suppliers regarding the legal status of their products.

Lastly, the CIDs request copies of any permits, licenses, or other certificates issued by government entities that purport to allow the companies to sell their products to consumers in Missouri.

Delta-8, a psychoactive substance derived from hemp, has been banned or heavily restricted in nearly half of U.S. states due to health risks and medical cannabis lobbying.
